Welcome to Sua Altezza and the Sua Altezza VIP Program ("Program"). By accessing sua-altezza.com ("Site") or participating in the Program, you agree to be bound to these Terms & Conditions ("Terms"). Please read them carefully. These Terms govern your use of the Site, purchases of Sua Altezza products, and participation in the Program or related events. Sua Altezza reserves the right to modify, suspend, or terminate the Site, Program, or these Terms at any time, with notice provided via email or the Site.

1. General Provisions

  • Acceptance: Using the Site or enrolling in the Program constitutes acceptance of these Terms, our Privacy Policy (#), and any additional policies linked on sua-altezza.com.
  • Updates: Sua Altezza may update these Terms at any time. Continued use of the Site or Program after updates constitutes acceptance. Members will be notified of material changes via email or the member portal.
  • Eligibility: Users and Program members must be 21 or older, per US federal tobacco regulations (21 CFR Part 1140), and provide valid government-issued ID for age verification upon request.

2. Sua Altezza VIP Membership Program
2.1 Membership Tiers

  • Tiers and Fees:

    Gold Tier: $2,500 annually
    Platinum Tier: $6,500 annually (limited availability)
    Diamond Tier: $10,000 annually (limited to 50 members only nationwide)

  • Payment: Fees are charged annually in US dollars (USD) via the payment method provided at enrollment. Applicable federal, state, and local taxes are added at checkout.
  • Renewal: Membership renewal will be offered to existing Members prior to being opened to the public. Note: Diamond-Club is limited to 50 members only annually. 
  • Non-Refundable: Fees are non-refundable except as outlined in Section 5.

2.2 Events

  • Exclusive Events: Platinum and Diamond members may receive invitations to Exclusive events (e.g., a Tampa Pairing event or the Diamond Unveiling event). Specific terms apply (see Section 8).
  • Plus-One Policy: Diamond members may bring one pre-registered guest to designated events, subject to a fee ($250), age verification (21+), and capacity limits. Guests do not receive member-exclusive items (e.g., Annual Unveiling cigar).

3. Product Purchases

  • Products: Sua Altezza offers cigars (e.g., 24kt gold leaf cigars), accessories (e.g., carbon fiber tubes, exotic leather wallets, revolver humidors), and gift packages via sua-altezza.com.
  • Pricing: Prices are in USD, excluding taxes and shipping, which are calculated at checkout.
  • Orders: Orders are processed upon payment confirmation. Sua Altezza reserves the right to refuse or cancel orders for any reason, including inventory issues or suspected fraud.
  • Returns: Cigars and tobacco products are non-returnable due to health regulations, except for damaged or defective items. Email contact@sua-altezza.com within 7 days of receipt for resolution.

4. Shipping and Delivery

  • Origin: Cigars are produced in Costa Rica and shipped domestically to US addresses via our US distribution hub (e.g., Florida).
  • Restrictions: Tobacco shipments are subject to state and local laws. Sua Altezza will not ship to states where online tobacco sales are prohibited (e.g., California, New York, Massachusetts). Members must verify compliance with local regulations.
  • Taxes and Fees: Members are responsible for federal, state, and local taxes, plus shipping and handling fees, added at checkout.
  • Delivery: Monthly cigar allocations and other products are shipped to the member’s designated US address. Members must provide accurate shipping information.
  • Condition: Products are shipped in climate-controlled packaging. Report damage or discrepancies within 7 days to contact@sua-altezza.com.

5. Cancellation and Refunds

  • Member Cancellation: Members may cancel their membership via contact@sua-altezza.com or the member portal. Cancellations take effect at the end of the current term.
  • Sua Altezza Cancellation: Sua Altezza may terminate memberships for non-payment, violation of Terms, or illegal activity, with notice. A prorated refund may be issued at Sua Altezza’s discretion.
  • Refunds: Membership fees and product purchases are non-refundable, except for Sua Altezza’s failure to deliver promised benefits or products, subject to review. Refund requests must be submitted within 30 days to contact@sua-altezza.com. Refunds are not permitted for Membership non-use.
  • Non-Delivery: If shipments are undeliverable due to incorrect member-provided addresses, no refunds are issued, but Sua Altezza may reship at the member’s expense.

6. Lounge Partnerships

  • Access: Platinum and Diamond members may receive perks at select US partnered lounges (e.g., reserved seating, complimentary drinks) when smoking Sua Altezza cigars, subject to partner agreements and capacity.

    Platinum Tier: Reserved seating and one complimentary drink per visit, up to 4 visits/year.
    Diamond Tier: Complimentary entry, VIP seating, and locker access (if available).

  • Verification: Members must present a Sua Altezza membership card and be 21+ with valid ID.
  • Limitations: Perks are not guaranteed and depend on lounge policies, capacity, and availability. Sua Altezza is not liable for lounge-related disputes.

7. Event Terms

  • Eligibility: Events are open to invited members (e.g., Platinum and/or Diamond) and one pre-registered guest (Diamond only, subject to $250 fee and capacity). All attendees must be 21+ with valid ID.
  • RSVP: Members must confirm attendance by the specified deadline. Guest registration requires age verification.
  • Exclusivity: Member-exclusive items (e.g., Annual Unveiling cigar), are not provided to guests.
  • Compliance: Attendees acknowledge tobacco health risks (e.g., “WARNING: Cigars are not a safe alternative to cigarettes”) via RSVP or event signage.
  • Conduct: Attendees must adhere to venue dress codes (e.g., business formal) and policies. Sua Altezza may deny entry for non-compliance.
  • Photography: Attendance grants Sua Altezza permission to use photos/videos for promotional purposes.
  • Cancellation: Sua Altezza may cancel or modify events with notice. Guest fees are non-refundable unless Sua Altezza cancels.

8. Intellectual Property

  • Ownership: The Sua Altezza logo, designs, and Site content are owned by Sua Altezza and may not be used without written permission.
  • Member Content: By submitting content (e.g., via the X community), members grant Sua Altezza a non-exclusive, royalty-free license for promotional use.

9. Limitation of Liability

  • General: Sua Altezza is not liable for indirect, incidental, or consequential damages arising from the Site, Program, or events, except as required by law.
  • Product Use: Members acknowledge tobacco health risks and assume all risks of use, per FDA warnings.
  • Maximum Liability: Sua Altezza’s liability for any claim shall not exceed the member’s annual membership fee or purchase amount.

10. Privacy and Data

  • Collection: Sua Altezza collects personal information (e.g., name, address, payment details, ID) to administer the Program, process orders, and comply with regulations.
  • Use: Information is used for Program management, marketing (with opt-out options), and compliance. See our Privacy Policy (#) for details.
  • Security: Sua Altezza uses industry-standard security but is not liable for unauthorized access beyond its control.

11. Dispute Resolution

  • Governing Law: These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
  • Arbitration: Disputes shall be resolved through binding arbitration in Orlando, FL, under American Arbitration Association rules. Members waive jury trials and class actions.
  • Costs: Each party bears its own legal fees unless otherwise determined by the arbitrator.
